A friend is the executor of his fathers small estate and needs to cash in his deceased fathers stock. He called his lawyer who seems confused as to how to do it, but the lawyer says it must be done. My friend has all the paperwork – EIN, death certificates, etc. He has the stock certificate in hand. He lives in NY State. What is the best way for him to cash in the stock for money? Will he be charged a fee?

My uncle died without leaving a will or naming an executor to his estate. His spouse is deceased and he had no children. It will fall on my aunts and uncles to sort things out. How do they go about naming an executor to his estate? Will we need a lawyer? He lived in Texas.

If someone dies and you pay the estate tax to the state on their assets at time of death (say 4%), do the heirs then also pay a federal tax on the amount that they get distributed from the balance of the estate?

I was appointed administrator of my uncle’s estate. I thought he had his financial records…Unfortunately, he died incompetent and no will (intestate)…There are no legal records. I live in KS…He lived in NY. He filed no taxes with the IRS, since 2003. My records began in 2007. What do I do if I do not have any financial records and there is a small estate connected to 2 mortgage notes?
