if there is no will…Then the court would have to appoint a Personal representative..most states have it in order of relationship….spouse, children, brother sister….But the Court to answer your question…because the Rep will have to file an accounting….what kind of assets did the decedent have..I mean if it was a house and stock…he would not be able to avoid reporting..if it is cash under her mattress…..then…….that is a tricky situation…….By the way..who are the heirs..with no will that is again based on state law.. You Really should consult a local probate attorney…..

You need to see a lawyer or there will be major problems. There are 5 kids, most likely the estate will be evenly split amongst the 5 after all outstanding bills and the lawyer is paid.

You should consult a probate lawyer where the estate is located. Laws vary from state to state. In most states if there is no will left and no surviving spouse the natural born children share equally. Unadopted children usually have no inheritance rights in the case of intestacy.

If you are, then you are. You must decide what goes where. The person that put you in charge felt that you were the one person that they could count on to deal with the distribution of their estate. When in doubt, contact a trusted person that you hold highly to give you council or talk to an independent lawyer.
